Terms of Use

1. Purpose

These Terms of Use govern access to and use of the FastWebScraper service (hereinafter "the Service"), available at fastwebscraper.com.

2. Service Operator

3. Professional Use Only

The Service is intended exclusively for professional use. By registering, the user declares that they are acting within the scope of their professional, commercial, craft, or freelance activity, and not as a consumer within the meaning of the preliminary articles of the French Consumer Code.

Accordingly, the protective provisions of the French Consumer Code (in particular articles L.211-1 et seq. relating to the legal guarantee of conformity, and provisions relating to unfair terms) do not apply to the relationship between the operator and the user.

4. Service Description

FastWebScraper is a SaaS web scraping platform that allows users to extract data from websites via a REST API. The Service includes access to the API, dashboard, and documentation.

5. Registration and Account

  • Registration requires a valid email address and password.
  • Users are responsible for the confidentiality of their credentials and for all activity performed under their account.
  • Each user may only have one account.
  • Information provided must be accurate and up to date.
  • Users must notify the operator immediately if they suspect their credentials have been compromised.

6. Acceptable Use

Users agree to:

  • Respect the terms of use of scraped websites
  • Not use the Service for unlawful purposes
  • Not attempt to circumvent the Service's security measures
  • Not overload the Service's infrastructure
  • Not resell access to the Service without authorization
  • Not use the Service to collect personal data without a valid legal basis under the GDPR

7. User Responsibility — Legality of Scraping

The user is solely responsible for the legality of their use of the Service. It is the user's responsibility to verify that data extraction from target websites complies with applicable laws, the terms of use of said websites, and any regulations relating to personal data protection.

The operator provides a technical tool and exercises no control over the websites targeted by the user or the use of extracted data. The operator cannot be held liable for any use of the Service that violates the law or the rights of third parties.

8. Indemnification

The user agrees to indemnify and hold harmless the operator against any claim, action, damage, cost, or expense (including reasonable legal fees) arising from the user's use of the Service, a breach of these Terms, or an infringement of third-party rights.

9. Intellectual Property

The Service, its source code, design, and documentation are the exclusive property of the operator and are protected by intellectual property law. Users retain ownership of data they extract through the Service. Any reproduction, modification, or redistribution of the Service or its components is prohibited without prior written authorization.

10. Availability and Support

The Service is provided on a "best effort" basis. The operator does not guarantee any level of availability, minimum response time, or service level agreement (SLA).

Support is provided by email at contact@fastwebscraper.com. Requests are handled within a reasonable timeframe, with no guaranteed response time.

The operator reserves the right to temporarily interrupt the Service for maintenance, updates, or security reasons, without prior notice or compensation.

11. Limitation of Liability

The Service is provided "as is" and "as available," without warranty of any kind, express or implied, including but not limited to warranties of fitness for a particular purpose or uninterrupted operation.

The operator shall not be liable for any indirect damage, including but not limited to: loss of revenue, loss of data, loss of customers, loss of opportunity, reputational damage, or any consequential or incidental financial loss.

In any event, the operator's total liability under these Terms is capped at the amounts actually paid by the user during the three (3) months preceding the event giving rise to the claim.

12. Force Majeure

The operator shall not be held liable for any failure to perform its obligations resulting from a force majeure event within the meaning of Article 1218 of the French Civil Code, including but not limited to: natural disaster, fire, network or power failure, third-party technical provider failure, cyberattack, administrative or judicial decision, pandemic, or any event beyond the operator's reasonable control.

13. Suspension and Termination

The operator reserves the right to suspend or terminate an account in case of violation of these Terms, without notice or compensation. In case of suspension, any remaining credits shall not be refunded.

Users may delete their account at any time from the dashboard.

14. Changes to Terms

The operator reserves the right to modify these Terms. Users will be notified by email of any substantial changes at least thirty (30) days before the new terms take effect. Continued use of the Service after this period constitutes acceptance of the updated Terms. If the user does not agree, they must stop using the Service and delete their account.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

16. Governing Law and Jurisdiction

These Terms are governed by French law. In the event of a dispute, and failing amicable resolution within thirty (30) days, the courts of Montpellier shall have exclusive jurisdiction, including in summary proceedings, third-party proceedings, or cases involving multiple defendants.
