Terms of Sale - FastWebScraper

1. Purpose

These Terms of Sale govern the conditions for subscribing to and purchasing services offered by FastWebScraper. They apply exclusively between professionals, in accordance with Article 3 of the Terms of Use.

3. Services and Pricing

FastWebScraper operates on a credit-based model. Credits are used to perform scraping requests via the API. Current pricing is displayed on the Pricing page.

A free plan is available with a limited number of credits.
Paid plans offer higher credit volumes.
Unused credits do not roll over to the next month unless otherwise stated.
Credits represent a right to use the Service and have no monetary value outside the platform.

4. Payment

Payments are processed by Stripe, Inc.
Subscriptions are billed monthly.
Prices are displayed in euros (EUR), tax inclusive. VAT not applicable per article 293 B of the French General Tax Code (CGI).
In case of payment failure, access to the Service may be suspended immediately and without notice.

5. Late Payment

In accordance with articles L.441-10 et seq. of the French Commercial Code, any late payment shall automatically result in:

Late payment penalties calculated at the interest rate applied by the European Central Bank to its most recent refinancing operation, plus 10 percentage points, applied to the tax-inclusive amount of the outstanding sum;
A fixed recovery indemnity of forty (40) euros;
If actual recovery costs exceed this fixed amount, additional compensation may be claimed upon presentation of supporting documents.

6. Right of Withdrawal

As the Service is intended exclusively for professionals, the provisions relating to the right of withdrawal under the French Consumer Code do not apply.

As a commercial courtesy, for subscriptions where no credits have been consumed, a refund may be requested within 14 days of purchase by contacting contact@fastwebscraper.com. This commercial courtesy does not constitute a right and may be withdrawn at any time.

7. Refunds

Consumed credits are non-refundable under any circumstances.
In case of a proven and documented Service malfunction attributable to the operator, a credit may be granted on a case-by-case basis, at the operator's sole discretion.
Refund requests must be sent to contact@fastwebscraper.com within thirty (30) days of the incident.

8. Price Changes

The operator reserves the right to change pricing. Users will be notified by email at least 30 days before new prices take effect. Users may cancel their subscription before the new prices apply.

9. Cancellation

Users may cancel their subscription at any time from the dashboard. Cancellation takes effect at the end of the current billing period. No pro-rata refund will be issued for the remaining period.

The operator may terminate the user's subscription in case of a breach of the Terms of Use or these Terms of Sale, with immediate effect and without refund of remaining credits.

10. Force Majeure

The operator shall not be held liable for any delay or failure to perform its obligations resulting from a force majeure event within the meaning of Article 1218 of the French Civil Code.

11. Severability

If any provision of these Terms of Sale is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

12. Governing Law

These Terms of Sale are governed by French law. In the event of a dispute, and failing amicable resolution within thirty (30) days, the courts of Montpellier shall have exclusive jurisdiction.
